In criminal proceedings,the judicial authorities represent the State and command great power and resources,while criminal suspects and defendants are placed in a comparatively disadvantaged position whose rights may be easily violated. Therefore,the State and society need to take special measures to protect their rights.738330 The protection of citizen’s rights in criminal proceedings by State is not just to protect human rights but also to protect the State itself. The protection of citizen’s rights in criminal proceedings is manifested in the way that the State,by exercising its judicial power,addresses both the relation between individual citizens and the relation between the State and citizens.738331 The handling of such relations is the basis and prerequisite for the protection of citizen’s rights in criminal proceedings and the fundamental system and mechanism of protection in the constitution and law. The Chinese constitution and law provide a fairly comprehensive system to safeguard citizen’s rights in criminal proceedings.
