本文考察了东欧转型国家的土地产权制度改革。由于在改革之前,各国的合作社农业类型各不相同,因此改革的程序和实践也因国家而异。尽管如此,历史公义原则在各国均发挥了至关重要的作用,由此导致了双重后果。首先,土地所有权变得稳固但又如此分散,以致其重要性大打折扣。在转型中谁能成为赢家,谁能成为输家,抑或谁能成为成功的“后社会主义”农民,均不取决于土地产权,反而是文化资本和社会资本在这方面显得更为重要。然而,随着更多的人认为迅速增长的农村贫困人口应该依靠手中的土地为生,上述现象同样促成了一种忽视农村贫困群体需求的思维方式。本文在最后部分研究了中国社会出现上述特征的可能性。
,AbstractEN:This paper examines the reform of land property rights in the transitional countries of Eastern Europe.Procedures and practices differed from country to country depending on the pattern of collectivised agriculture that had preceded it,nevertheless in all countries principles of historic justice played a significant role.This is seen to have had two consequences.First,land ownership became secure but so widespread that it lost much significance.It did not determine who were the winners and losers in transition,or who would become successful post-socialist farmers.Cultural capital and social capital were much more significant in this respect.But it also fostered a mindset that directed attention away from the needs of the fast-growing rural poor by promoting the view that they should cope on the land that they had.The paper concludes by considering the relevance of these characteristics to the Chinese context.

,AbstractEN:The history of the national liberation revolution and the economic development of Vietnam are both related to land.Reform in the agricultural sector,particularly in relation to land,commenced as part of the Doi Moi(renovation)policy in 1986.Today,farmers have land use rights including the rights of exchange,transfer,lease,release,inheritance,mortgage,gifting land,and the right to use the value of land use rights as joint venture capital for stable and long-term use.However,many challenges in relation to land occur including land equity and inequity.The land policy has different impacts on the issue of land equity and inequity.

,AbstractEN:The current land system,inherited from the Central Planning System,displays serious shortcomings of a dual economy based on urban-rural divide and de facto segregation.This article briefly introduces US farmland system,land market,the main constitutional and legal principles governing the government land takings,including police power,eminent domain,zoning,and farmland preservation,etc.Hopefully,China will find that the US experience might be of much more relevance to China’s effort to reform the current land system in the direction of a true market system.

美国土地利用规划对于我国的借鉴意义体现在五个方面:加快土地规划的法制建设,制定《土地规划法》及其配套的法律法规和规章;建立与新形势相适应的土地利用总体规划体系,制定《规划法》,协调土地利用规划与城市城镇规划、环境保护规划的关系;拓展公众参与的广度和深度;充分运用3S技术科学编制和管理土地利用规划;严格修改规划的程序和标准。
,AbstractEN:The land resources management in America features diversified land ownership and the land management policy of the Federal Government has generally undergone the three stages of extensive management,coordinated transition and strict scientific management.The Bureau of Land Management under the Department of the Interior is the principal land management institution.Land resources management mainly involves the Department of the Interior and the Department of Agriculture and is in both the centralized and decentralized management modes on the federal level.The Bureau of Land Management under the Department of the Interior is the principal land management institution.Every state manages land resources centrally and more than 20 states have established resources and environment departments.
The major characteristics of American land use planning are in four aspects:the American land use planning system is generally divided into the three categories of general planning,special planning and management planning of land use growth and into the five levels of the regional level,state level,sub-regional level,county level and municipal level.A sound legal guarantee is available for land use planning and the federal government controls,leads and influences local land use and planning management mainly by making relevant laws,regulations and policies.It uses the geographic information system,remote sensing,global positioning system and other modern technical means a lot for scientific planning and management systems;protection of farmland and ecology is fully reflected in land use planning;and public participation is an important link in preparation and revision of land use planning.
The reference meaning of American land use planning for our country is reflected in five aspects:accelerating legal system building for land planning and making a law on land planning and its corresponding law,regulations and rules;establishing a general land use planning system adjusted to the new situation,making a law on planning and coordinating the relationship between land use planning and urban and town planning and environment protection planning;expanding the extent and depth of public participation;making full use of the 3S technique to prepare and manage land use planning scientifically;and strictly revising the procedure and standard of planning.

,AbstractEN:This paper reviews the process of China’s land market based on its policy evolution and local enforcement.In the past 30 years,the farmers’ contracting land market has evolved from voluntary transaction to a regulated market transaction.The land circulation market has become a dual structure of “two rights system,two markets,two legal system” in which the primary land market has been controlled by the local government.The collective construction land market has evolved from open access to limited entry till illegal use.The state construction land market has evolved from administrated allocation to compensated use till market selling of commercial construction land.Some policy suggestions have presented.

,AbstractEN:There are in-depth reasons for the fact that the Real Right Law of the People’s Republic of China(“Real Right Law”)fails to solve the problem of rural land right issues ideally and policymakers’ anxieties and worries are well grounded and should be fully understood.However,we should also know that conditions for advancing the above reform are basically available and the opportunity for carrying it out is increasingly mature.Mortgage of contractual land right should be allowed.Farmer’s requirements amount to allowing collective construction land to enter the market.The rural house site market plays a very active role in satisfying the needs of various strata.But as the market is not under the protection of law,it’s very difficult to deal with disputes once they arise.Opening the rural house site market is already inevitable.Only after the huge management loophole is filled can the phenomenon of occupying cultivation land randomly be eliminated practically.

,AbstractEN:Compensation of land taking should reflect the relationship between the land right holders and the dominant domain power of the government.As a result,reasonable compensation should be based on the effective bargaining process of the effected parties.This process is not always based on a free market.But it should not be a unilateral pricing by the government either.However,an examination of the past land reform in China shows that land compensation has been taken as a way of reallocation of land resource by the government.This has led to 3 fundamental problems in the land laws in China:First of all,many laws and regulations ignore legal construction of bargaining process in the land taking or land requisition process.Secondly,even when there are such procedural requirements,legal protection of enforcement of such procedural requirements is far from sufficient.Thirdly,bargaining powers are discriminatory different between the rural right holders and urban right holders.In order to reduce land disputes and maintain the stability of property relationship,it is suggested in this article that bargaining power and procedures that have been proved efficient in practice should be crystallized by law,which should entitle full legal and especially judicial protection to land right holders in both urban and rural areas.

,AbstractEN:The Decision of the Central Committee of the Communist Party of China on Several Significant Issues in Promoting Rural Reform and Development passed at the Third Plenum of the Seventeenth National Congress of the Communist Party makes it clear that the “current contractual land relationship should be kept stable and unchanged for a long time”,which changes the former wording of “ensuring long-term stability of contractual rural land relationship” and means there will be no limitation on duration of contractual land right and the right will be perpetuated.Therefore relevant laws,regulations and supporting policies should be drafted as soon as possible.Perpetuation of contractual land right requires rebuilding of the functions of contractual land right.Although the current system has acknowledged possession,use and the profiting function of contractual land right,it limits its right of disposal.Attention should be paid to improvement of its right of disposal in improvement of its functions.Therefore,it’s very necessary to distinguish creditor right disposal from property right disposal clearly.Subcontracting,renting and other creditor right disposal without changing the main bodies of contractual land right should be allowed under the concept of contractual freedom and transfer,exchange,stock cooperation and other property right disposal with the characteristic of changing the main bodies of contractual land right should be fully guaranteed under the precondition of perfecting rural social security and expropriating contractual land right of the function of social security.Meanwhile,mortgage by contractual land right acquired by way of household contracting should be allowed to fully realize the exchange value of contractual land right and expand the scope of effective rural guaranties.Inheritance of contractual land right as property of specific rural households should also be allowed under perpetuated contractual land right.

,AbstractEN:The right registration system has the functions of identifying land right,screening off local burdens and protecting farmers’ interests.Only by strengthening the land right registration system and ensuring stability and transparency of rights,can the gate to marketization be opened for rural land.But the pity is the right registration system has not been adopted for rural land in legislation and basically confirmation of right has not been developed in practice.Although there exist such difficulties as land fragmentation and high registration cost,it is necessary for the state to further strengthen registration of rural land right,confirm all kinds of rural land use rights by registration and adopt the registration validity doctrine for change of property right in order to maintain long-term stability of land right and development of the market.

,AbstractEN:The usufruct is the legal basis of the rural land ownership.Adhering to the independent status of the usufruct,the Real Right Law not only realizes the scientification of the structure of rural land rights in legislation,but also provides the basis for the protection of farmers’ land rights in practice.The new land policy of the Central Government gives steady support to rural land rights.In the context of the integration of urban and rural areas,the point of pressing forward the rural land right system is to establish a land right system based on jurisprudence on the premise of solving problems in land rights.The priority in rural land rights should be coping with the limit to the transfer of land rights and the conflict between rules for property right and establishing a two-level management system on the basis of civil law.Furthermore,the conflict between different land rights and the relationship between the changes in land rights and the land administration should be resolved gradually in the establishment and practice of the system so that such relationship can meet the basic requirements in land system and be spported by scientific theories.Currently,we should be well aware of the impact of farmers’ collective membership on the conflict and distribution of land rights.We should also regard the reestablishment of farmers’ collective membership as a significant issue and,by such reestablishment,effectively deal with the relationship between farmers and collectives in the two-level management system.

,AbstractEN:The Third Plenum of the Seventeenth National Congress of the Communist Party of China determined the reform way of marketizing the rural land system.But the land element is different from ordinary commodities.Therefore,its transaction should be controlled more by the state and the scale,quantity,purpose and way of its transaction are strictly restricted by the state policy.For that reason,marketization of the rural land element is not full liberalization and this is also the important spirit of the “decision” made at this plenum.Before the “decision” of the Central Committee was published,the society had expected in-depth reform of the land system;after it was published,it seems the society has entirely different understanding of it.This article is about my understanding of the decision after study.
