中国的劳资关系是随着近代工商业的发展而出现的。改革开放以来,随着中国市场经济的发展,劳资关系逐渐进入大众视野并成为现时代基本的社会关系之一,劳资关系问题引起广泛关注,对劳资关系的研究也越来越多。
劳资关系本质上是一种市场合作关系,在冲突中合作,在合作中冲突。在珠三角非公企业中,合作与冲突并存构成劳资关系的基本态势。其中,合作成为劳资关系的主流态势。合作的根源主要有两方面,即“被迫”和“获得满足”。“被迫”是由于雇员如果要谋生,就得与雇主建立正常的雇佣关系。“获得满足”主要是由于雇员对雇主有基本的信任,雇员能认识和体会到其工作的价值,管理方也在努力不断提高雇员的满意度。虽然合作是劳资关系的主流态势,但矛盾和冲突仍不可避免,甚至呈高发态势。劳资矛盾形成的原因具有综合性和复杂性。程延园教授认为,冲突的根源可分为“根本根源”和“背景根源”。综合近年来珠三角非公企业发生的劳资矛盾,杨正喜教授认为,劳资冲突的根本缘由在于异化的合法化、客观利益差异和雇佣关系性质;劳资冲突的背景缘由在于广泛存在的社会不平等及劳动力市场供过于求;而珠三角以农民工为劳动者主体的劳资冲突产生的直接缘由则在于权利受到侵犯,如劳动权和人格尊严受到侵犯,这是导致冲突的最主要因素。结合近年来珠三角劳资矛盾的爆发,分析其原因,总体有根本原因、制度原因、劳动者主体自身的原因及一些外部环境变化的原因等。
