《深圳劳动关系发展报告(2008)》以党的十七大精神和科学发展观为指导,以《中华人民共和国劳动合同法》颁布为契机,以“学法律、促发展”为主线,审视、记录了深圳在本年度构建和谐劳动关系方面的基本做法和特点,客观地分析了劳动关系发展中所存在的问题及原因,理性地预测了2008年劳动关系的发展趋势,对全方位依法维护员工及企业利益,实现发展企业和谐劳动关系的目标提出了对策建议。

2007年,深圳在学习贯彻《中华人民共和国劳动法》时,突出“以人为本”的新理念,坚持“以员工为本”,尊重员工的劳动和人格;在工业园区(社区)大胆尝试创建和谐劳动关系活动;全面推广劳动合同制度,将本年度确定为“劳动合同质量年”并开展了全面清理和修订劳动合同与集体合同文本的工作;在巩固国有、外资企业劳动合同签订率的基础上,将建筑业、餐饮业等作为重点行业,将外来劳务工作为重点人群,开展“劳动合同签约行动”等一系列活动,取得了理想的效果。统计资料显示,2007年,深圳企业的劳动合同签订率达到92.5%,比2006年增长10.3%,签订集体合同的企业达6121家,超出年初目标任务的141.8%。

2007年,深圳十分注重和谐劳动关系构建的制度建设和协调机制建设。现已建立“五大制度”:①劳动信访制度;②劳动调解制度;③劳动仲裁制度;④劳动监察制度;⑤劳动关系集体协商制度。建立了“十大协调机制”:①有效的劳动就业和劳动关系建立机制;②周密的劳动法律监督机制;③有效的劳资矛盾预警调处机制;④强力的劳动争议裁决机制;⑤平等的协商谈判机制;⑥公正的劳动工资共决机制;⑦良好的企业自我约束机制;⑧完善的企业责任追究机制;⑨多元的网络管理控制机制;⑩高效的劳动关系多方协调机制。这些“制度”和“机制”的建立,对深圳构建和发展国有、民营和外商投资企业等各类企业的和谐劳动关系起到了极其重要的作用,维护了社会的稳定,推动了深圳经济社会的平稳健康发展。

2007年,深圳还在完善集体协商和集体合同制度、解决拖欠农民工工资、加强劳动合同立法、推进劳动争议处理能力建设以及完善劳动关系三方协商机制等方面作出了理论和实践的探索。

本书强调,2008年,深圳要正确分析和把握劳动关系调整工作面临的形势,充分认识到三方协商机制在协调劳动关系、维护社会稳定和构建社会主义和谐社会中的重要地位,按照党的十七大提出的要求,抓住机遇把劳动关系三方协商机制做大做强,切实发挥它在宏观层面调整劳动关系的不可替代的作用。要坚持以构建社会主义和谐社会为统领,把维护劳动关系双方特别是劳动者的合法权益,促进劳动关系和谐稳定作为工作的出发点和落脚点,形成布局合理、协调有力的工作局面。要坚持协调、推进、调整劳动关系工作,把劳动关系协调、劳动争议处理和劳动保障检查工作作为一个有机整体,全面推进。要加强劳动关系法制建设,在立法、执法和宣传上下工夫。要进一步拓展职能,把就业、收入分配和社会保障等一系列问题作为协调劳动关系的重要组成部分。要进一步拓宽社会对话渠道,尽可能将有利于促进劳动关系和谐、维护社会稳定的社会力量和有识之士吸纳到三方协商机制中来。
