Applicants of Chen ** and Pan ** are spouse, and they are living with their son, the respondent Chen * Wei. Chen * Wei often maltreats two applicants because of family trifles. In the evening of March 18, 2015, Chen * Wei beat Chen ** to soft tissue injury on his head and body. In the morning of May 15, 2016, Pan ** fell when she tried to prevent Chen * Wei's beating on Chen **'s head. In the end, Chen ** was injured on his left shoulder scapula and Pan ** broke her right rib. On July 7, 2016, Chen ** and Pan ** applied for writs of habeas corpus to the People's Court of the Xianju County, Zhejiang province. They asked for Chen * Wei's mandatory moving-out of the house, as well as the prohibition of Chen * Wei's domestic violence. After investigation, the People's Court of the Xianju County of Zhejiang province approved Chen ** and Pan **'s application for personal safety protection according to the regulation of anti-domestic violence law. The verdict prohibited Chen * Wei's domestic violence towards Chen ** and Pan **. Chen * Wei didn't apply for reconsideration after receiving the verdict.
Above is a typical case of “Ten Model Cases” regarding the implementation of Anti-domestic Violence Law of the People's Republic of China published by the Supreme People's Court in 2017, in which two senior citizens from Zhejiang province applied for writs of habeas corpus. The evidences, including the medical records, medical certificates, and Chen * Wei's self-statement, all confirmed the respondent Chen * Wei's frequent beating-up of his parents. In order to protect the personal safety and rightful benefits of the two seniors, the Court made a verdict to prohibit Chen * Wei's domestic violence towards his parents, and issued writs of habeas corpus to the applicants. At the same time, the Court carried out related legal publicity during the process of serving the ruling onto the local village committee and local police station, and received support and cooperation from them. The local media also reported the handling situation of the case and helped the local people to have a deeper understanding and acceptance of the writ of habeas corpus.
Anti-domestic Violence Law of the People's Republic of China (hereinafter referred to as Anti-domestic Violence Law) was formally implemented on March 1, 2016. On the day of its implementation, Beijing, Hunan, Fujian, Jiangsu, Zhejiang and Shandong all issued the first writ of habeas corpus within their region. In the ten days after its implementation, Sichuan, Tianjin, Henan, Hainan, Shaanxi and Shanghai also issued their first writ of habeas corpus. Grass-roots Courts in Zhejiang province issued more than 110 writs of habeas corpus in 2016, which was more than the total number of the past 7 years. During the implementation process of Anti-domestic Violence Law, a series of measures including the establishment of “Hehe/Harmony” Family Mediation Studio and “A loving family” online anti-domestic violence service platform can be regarded as the models in China.
